Terms and Conditions for Yellavel Productions

1. Agreement to Terms
Welcome to Yellavel Productions! These Terms and Conditions ("Terms") constitute a legally binding agreement made between you ("you", "the user") and Yellavel Productions ("we," "us," or "our"), concerning your access to and use of the hrs.yellavelproductions.biz website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. User Eligibility
The Site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Term3s prior to you using the Site.
3. User Accounts
When you make a purchase through our Site, an account may be automatically created for you through our service provider, systeme.io. You are responsible for maintaining the confidentiality of any account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, or engage in any activity that is fraudulent, abusive, or otherwise illegal, including but not limited to non-payment or intellectual property infringement.
4. Products, Services, and Delivery
We offer a variety of digital products and music services.
Digital Products (Beats, Beat Packs, Bundles): After a successful purchase, digital products are delivered via two methods: a direct download link on the post-purchase "Thank You" page, and through access to a membership area where you can download your purchased files.
Music Production Services (Mixing, Mastering, Cover Art, etc.): Services are paid for upfront and are completed on a first-come, first-served basis. The number of included revisions for each service is stated on the corresponding "Services" page and post-purchase "Thank You" page. Any revision requests that exceed this stated limit will be subject to an additional fee of $5 per revision.
Studio Time: Studio time must be booked and paid for in advance. The service is delivered at the scheduled appointment time.
5. Payments and Refund Policy
We are committed to a clear and fair refund policy.
Individual Beats: All sales of individual beats from our beat store (hosted by Soundee.com) are final. No refunds will be issued for these purchases.
Digital Beat Packs and Bundles: We offer a 30-day money-back guarantee on all digital beat packs and bundle offers.
Music Production Services: A refund for a music production service must be requested prior to the completion and final delivery of the service.
Studio Time: A full refund for studio time can be requested by canceling or rescheduling your appointment at least 12 hours in advance. If you do not show up for your scheduled appointment and fail to provide at least 12 hours' notice (a "No Call/No Show"), your payment will be forfeited and will constitute a "No Call/No Show Fee." You will not be entitled to a refund and will be required to submit a new payment to book another appointment.
6. Intellectual Property Rights
A. Site Content:
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. Some products or content hosted on the Site may be owned by our partners or affiliates, and are the property of their respective owners.
B. Beat Licensing:
Our Site offers two distinct types of transactions for our beats: non-exclusive leases and the sale of exclusive rights. It is crucial to understand the difference:
Non-Exclusive Leases: When you purchase a non-exclusive lease for a beat, you are purchasing a license to use that beat according to specific terms. Yellavel Productions retains full ownership of the beat's composition, and we may continue to lease the same beat to other customers.
Exclusive Rights: When you purchase the exclusive rights to a beat, you are purchasing the full ownership of the beat's composition. Upon successful completion of this transaction, all ownership rights are transferred to you, and the beat will be immediately removed from our store and will not be sold or leased to any other party.

7. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:
Use the Site for any illegal or unauthorized purpose.
Attempt to hack, disable, or otherwise compromise the security of the Site.
Upload or transmit viruses, Trojan horses, or other malicious software.
Use any automated system, such as bots or spiders, to access the Site.
Engage in any form of intellectual property theft, including downloading free or purchased beats and attempting to sell or distribute them as your own.
Attempt to reverse-engineer any of our digital products.
8. Governing Law
These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Iowa applicable to agreements made and to be entirely performed within the State of Iowa, without regard to its conflict of law principles.
9. Changes to These Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Effective Date" of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Site after the date such revised Terms are posted will be deemed as your acceptance of the changes.
